Federal Trade Commission Guidelines
EcoPlum™ understands and complies with The Federal Trade Commission (“FTC” or “Commission”) guidance pertaining to environmental advertising and marketing. FTC has issued Green Guides under 16 CFR Part 260, to assist marketers in avoiding environmental claims that are unfair or deceptive under Section 5 of the FTC Act 15 U.S.C. 45. These green guides outline general principles that apply to all environmental marketing claims. The Guidance advises that qualifications and disclosures of environmental marketing claims be sufficiently clear and prominent to prevent deception. In addition, marketers are to make sure that claims apply to the product, and their claims not overstate an environmental attribute or benefit, expressly or by implication. EcoPlum™ conducts its business in compliance with the FTC guidance, given the fact that EcoPlum™’s methodologies for selecting products for the EcoList™ are clear, prominent and understandable.
Although these Green Guides are interpretations of the law and do not have the force and effect of the law, the Commission can still take action under the FTC Act, especially in situations that make environmental marketing claims inconsistent with the Green Guides. If any enforcement action is initiated by the Commission on a product listed by EcoPlum™, EcoPlum™ reserves the right to remove that product. EcoPlum™ will remove any product listed, if it is determined that the product is out of compliance with the FTC's Green Guides.
